Fees

Arbitrators’ / Mediators’ fees range from $250 to $600 per hour plus GST, depending on the experience of the arbitrator. Most arbitrators and mediators also have hearing day rates in addition to the hourly rates for non-hearing days. Please contact the arbitrator or mediator to obtain rates, availability, and conditions for a specific arbitrator. Fees and retainers are set individually by each arbitrator or mediator and you must contact them individually to discuss fees and retainers.

Note that writing arbitral awards is notoriously time-consuming when done well. As a general rule, clients should expect that each half-day spent at an arbitration hearing will require one full day of writing time afterward.

In most circumstances, clients are also responsible for all reasonable and necessary expenses incurred in connection with the arbitration, mediation, or med-arb services provided, including experts’ fees, accommodation where meetings and hearings are located elsewhere than Lethbridge, boardroom booking fees, equipment rentals and photocopying when commercial printing services are used. 

If an arbitration is cancelled more than 30 calendar days before the commencement of the arbitration hearing, the cancellation fee will be $500 plus the hourly rate of the arbitrator(s) or mediator(s) for time spent by the arbitrator(s) or mediator(s) prior to notification of the cancellation. If the arbitration is cancelled or adjourned within 30 calendar days of the scheduled commencement of the arbitration hearing, the cancellation fee will be half of the amount of the deposit required to be posted (set out above). If the arbitration is cancelled within two weeks of the scheduled commencement of the arbitration hearing, the cancellation fee will be the full amount of the deposit required to be posted (set out above).

If the arbitrator is able to re-book the time scheduled for the arbitration or mediation with other paying work, the cancellation fee will be reduced by half of the amount received by the arbitrator or mediator.
